By accessing or viewing this Website, by booking or attending a Class or by purchasing a Membership, you agree that you have read, understand and will comply with these terms and conditions.

This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.liftclub.co.nz and for your use of Lift Club services. 

You are only authorised to use the Lift Club Services if you agree to abide by all applicable laws and these Terms and Conditions. 

If you wish to become a Member, you must read these Terms and Conditions and indicate your acceptance during the registration process.

Terms & Conditions

YOUR ACCOUNT

To purchase a membership and attend classes you will need to create an account with our membership platform. You will need to provide us with accurate personal information, bank account or credit card details and confirm you are fit to attend Lift Club sessions.

By purchasing a Membership, you agree that all information provided by you is true and correct and that you will maintain and update this information in order to keep it current, complete and accurate.

All personal information collected by us is held in accordance with our Privacy Policy.

YOUR MEMBERSHIP

Memberships will run for the Membership Term and cannot be terminated early other than in accordance with this Agreement.

You must be over the age of 18 to purchase a Membership or attend a Class. If you are between 16 and 18 you may purchase a Membership or attend a Class with Lift Club approval and the consent and signature of a parent or guardian.

Memberships are billed on a weekly basis via direct debit or credit card.

Memberships give you access to Lift Club facilities during class hours only.

Lift Club Max memberships allow an unlimited number of class bookings each week.

Lift Club Strong memberships allow up to two (2) class bookings per week. Credits must be used within the week and do not roll over to the next week.

Club packs allow 5, 10 or 20 class bookings during the pack time period. All pack sessions must be used before the expiry date. No refunds will be made in the event that sessions are not used prior to expiry.

You acknowledge that Lift Club charges fees for its services, and reserves the right to change its fees from time to time at its discretion.

MEMBERSHIP BOOKINGS

Lift Club bookings can be made 14 days in advance. 

Classes are capped at 16 (Build) and 24 (Capacity) to ensure high quality coaching and safety is maintained. 

If the class is full, we recommend members join the waitlist in case of cancellations. 

If you book a class and can't make it, you agree to log in to change or cancel your booking at least 2 hours prior to the class start time so that another member can attend in your place. 

Members must be present 5 minutes prior to the class start time.

Members arriving more than 5 minutes after the scheduled class start time will only be granted access to the class at the coaches discretion. If granted access the member will be required to wait until the next block of training during the session to join.

If you fail to book, we will try our best to find you a spot but cannot guarantee participation in the class.

OTHER FEES

When you purchase a Membership, you will pay a one-time Account set-up fee of $15 unless otherwise stated in your membership agreement.

A processing fee will be billed in addition to your weekly Membership Fee. Processing fees are 1% for direct debit payments, and 3.25% of fees for credit card payments. This fee is subject to our billing provider’s processing rates, and may be subject to changes set by the provider.

FAILED PAYMENTS 

If a payment declines for any reason, we will attempt to process the payment every following day until payment has been collected. 

If after three (3) collection attempts the payment has not been received, bookings will be restricted until payment has been made.

CANCELLATIONS

Members may cancel their membership in writing via email to hello@liftclub.co.nz

Verbal communication to a staff member, text message, or social media direct message will not suffice and will not be actioned.

Membership cancellations require a two (2) week notice period.

If you require your membership to be cancelled for sickness, injury or other reasons during the minimum sign up period, you agree to pay out 50% of the remaining term or transfer to a friend.

MEMBERSHIP HOLDS

Memberships may be placed on hold for a minimum of two (2) weeks and a maximum of six (6) weeks in a 1 year period. 

To place a membership on hold you must provide one (1) week notice in writing via email to hello@liftclub.co.nz

Verbal communication to a staff member, text message, or social media direct message will not suffice and will not be actioned.

Holds cannot be backdated. 

A one-off admin fee of $20 applies for each hold period.

You can place a Membership on hold for a longer period than six weeks, if you are sick or otherwise incapacitated and you show us a certificate from a qualified medical practitioner stating that you cannot exercise for the rest of the extended period.

If your membership is on hold for longer than six weeks within a 1 year period, a $10.00 fee (plus processing fee) applies for each week of the extended hold period.

REFER A FRIEND REWARDS

To be eligible for LC referral rewards, the referred member must join on either a “Strong” or “Max” membership.

Referral rewards will be awarded 1 month after sign up.

VIDEO AND PHOTOGRAPHY RELEASE 

Lift Club uses photography and videography in order to record content for use in, but not limited to, marketing campaigns, social media, and web based platforms such as website and Lift Club app. 

By attending Lift Club classes you acknowledge that you may be subject to video and/or photo recordings which may be used by Lift Club subject to its Privacy Policy and these terms.

BELONGINGS

Lift Club is in no way responsible for the safekeeping of your personal belongings while you are present in the club. Lift Club provides a safe space built on honesty and trust, however you assume all risk of loss for any of your personal belongings.

LIMITATION OF LIABILITY

By signing up and attending classes, events, activities, and other programs and using Lift Club facilities and equipment, you hereby acknowledge that there are certain inherent risks and dangers in the strenuous nature of Lift Club training programs. You hereby acknowledge that you have voluntarily chosen to participate in an intense physical exercise program. You accept that you are now fully informed of this exercise program's strenuous nature and the possibility of adverse physiological occurrences by signing this document. “Lift Club” and the “weight stack” icon and other graphics, logos, wordmarks, and designs are trademarks of Lift Club in New Zealand. Lift Club’s trademarks and trade dress may never be used as part of trademarks and as part of domain names, in connection with any product or service in any manner that is likely to confuse and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Lift Club.

FIT TO TRAIN

You acknowledge that you are in good physical condition and know of no medical or other reason you cannot or should not do active or passive exercise. You recognise that the fitness instructor(s) cannot provide you with medical advice concerning your fitness. You agree not to hold any certified trainer or directors of Lift Club liable for any injury that may occur during a Lift Club class.
